QIX™ LEGAL DOCUMENT SUITE — INCORPORATED BY REFERENCE
This document is part of the Qix™ legal document suite. By using any Qix™ service or software you agree to ALL of the following documents, each incorporated herein by reference: Terms of Use; Service Agreement; Redemption Program Terms; Software License; Earnings Disclaimer. Precedence on conflict: Terms of Use → Service Agreement → Redemption Program Terms → Software License / Privacy Policy / Earnings Disclaimer. For cash conversion of Qix Credits, the Redemption Program Terms control over the Service Agreement.
Qix Information Technologies LLC issues a proprietary platform reward point called Qix Credits™ (also referred to herein as ‘Credits’ or ‘Qixit Credits.’). All references to ‘Credits’ in this Service Agreement refer to Qix Credits.
Thank you for visiting Qixit.com, Qixit.net, 2WayMicropay.com, and related websites (collectively, the “Site”) and for using Qixit™ services (the “Service”) and software (the “Software”), all owned by Qix Information Technologies LLC (“Qixit,” “we,” “us,” or “our”). Your use of the Site, Service, and Software is also governed by our Terms of Use, Service Agreement, Redemption Program Terms, and Software License, each of which is incorporated herein by reference. By visiting the Site or using our Service or Software, you agree to be bound by the terms of this Policy and all other documents in the Qix™ legal suite.
We review our privacy practices from time to time and our practices are subject to change. We ask that you periodically review this page to ensure familiarity with the most current version. All amended terms are automatically effective after they are posted on the Site.
1. Overview
This Policy describes: the information we collect from you and what may happen to it; how cookies are used; how your information is used; with whom your information may be shared; your options regarding collection, use, and distribution of your information; security precautions we take; and additional processing activities undertaken in connection with the Qixit Redemption Program.
You can browse the public areas of our Site without identifying yourself. If you choose to apply for a Qixit account or use our Service or Software, the information you provide will be used to screen and evaluate your application, provide updates, finalize software delivery, and offer you service. We do not collect personal data without your consent. Initiating the application process constitutes consent to use your information as described in this Policy.
2. How Qixit Uses Your Information
Qixit uses your information to provide our services, including a secure and cost-effective way to manage electronic communications and platform credit transactions, and a customized experience. We may also use your personal information to process orders, resolve disputes, troubleshoot problems, respond to inquiries, detect and protect against error, fraud, or other criminal activity, and enforce our agreements.
Information collected from your user profile, marketing profile, purchase patterns, and other uses of our services will be combined in central databases and may be used to develop and enhance our services.
3. What Personally Identifiable Information We Collect
The primary purpose of collecting information from you is to provide you with a secure, effective, and personalized experience. We collect only information we consider necessary to achieve this purpose.
Qixit collects information in several ways:
- Registration information: name, mailing address, phone number, email address, date of birth, and other basic demographic information
- Problem reports submitted via the Site, by direct mail, or by telephone
- Information provided when making a purchase or platform credit transaction
- Correspondence records if you contact Qixit
- Survey responses (never associated with personally identifiable information)
4. How We Increase and Monetize the Value of Your Information While Protecting Your Privacy
By using our service, you authorize us to collect information about you and your use of our services and to represent you in the sale of that information to third parties under conditions that reasonably protect your privacy while converting the value of that information into platform credits deposited into your account.
Your information is composed of two parts: Personally Identifiable Information (PII) — including your name, street address, date of birth, phone number, standard email address, your Qixit address, and any credit card or bank account information you supply; and Non-Personally Identifiable Information (non-PII) — including questionnaire and marketing profile responses, click-through and engagement data, commercial category purchase patterns, your age, zip code, and similar information that may increase the value of your market identity.
Commercial advertisers may indirectly query our database of non-PII, which produces aggregate summary results. These queries may result in your Qixit address being included in a mailing list — but no other PII is released to advertisers. Your Qixit address is not given to advertisers; instead, the approved commercial message is delivered directly from Qixit’s servers to your account along with your required delivery fee.
5. Personalization of Messages
Advertisers may include wildcard fields such as <FirstName> in their messages, which signals the Qixit software to replace the field with information from your personal profile. A message that begins “Dear Mr. Smith” does not mean the advertiser knows your name — it means the advertiser designed the message to be automatically personalized.
6. Information Accessible Through the User Directory
Unless you are a minor (under age 18), your account address, name, city, and state are searchable in our user directory. Your physical mailing address and phone number are not listed. People finding you in this directory can only communicate with you through your Qixit account and must pay your required message delivery charge. Minors will not be listed in our searchable directory.
7. Information Shared with Merchants
When making a purchase using Qixit, if you have preauthorized us to do so, your name and physical address may be automatically delivered to the seller along with your platform credit transfer. If you choose to withhold this information and provide an alternative delivery address, the seller may be notified that the delivery address differs from the account address on file.
If you respond to a commercial message by clicking a link or printing it, your Qixit address may be revealed to the sender. However, the sender’s use of your address remains restricted by your delivery charge settings and other restrictions in our user agreements with advertisers.
If you access our Services through the referral of a third party entitled to referral credits, we may share contact information such as your name and Qixit address with that business partner.
8. Cookies
Cookies are small files sent to your browser from a web server and placed on your computer’s hard drive to assist us in providing our services. Most are “session cookies” automatically deleted at the end of a session. We may use cookies to:
- Remind us of who you are when you log in and deliver a more personalized service
- Measure visiting patterns in aggregate to build higher quality services
- Determine your clickstream to our Site to enhance service and security
- Better personalize the content you and other users see on our Site
- Collect IP addresses for system administration and security
9. With Whom Does Qixit Share Your Information?
Your information will not be made available to third parties except: (1) with your permission; (2) under the terms described in Section 4 which provide financial remuneration to you under the terms you set in your Qixit account profile; or (3) under court order.
We may disclose account information where necessary to identify, contact, or bring legal action against someone who may be violating Qixit’s policies or applicable law, or causing injury to Qixit or other users. We may disclose or access account information when we believe in good faith that the law requires it and for administrative purposes necessary to maintain and improve our services.
10. Your Choices Regarding Your Information
Qixit will contact you if you request contact, if you create a Qixit account, or if you contact us directly. We may also send you messages through our Services and Software regarding related and unrelated products and services at no charge. You may manage message delivery charges and communication preferences through your Qixit account settings.
11. Your Use of Information from Other Parties
You agree to comply with all applicable local laws and rules regarding online conduct, privacy, and content. You agree to use any user information provided to you through the Qixit service solely for the purpose for which it was provided and in full compliance with that registered user’s Qixit account profile settings.
12. Security
Whenever Qixit handles your personal information, we take steps to ensure it is treated securely and in accordance with our user agreements and this Policy. Your information is stored on our servers located in the United States. We use procedural and technical safeguards — including encryption — to protect your personal information against loss, theft, and unauthorized access.
No data transmission over the Internet can be guaranteed to be 100% secure. We cannot warrant the security of any information you transmit to us, and you do so at your own risk. Once we receive your transmission, we make our best effort to ensure its security on our systems.
13. Note Regarding Qixit Credits™ and Financial Information
As more fully described in the Service Agreement, Qixit operates a proprietary points-based credit system, not a financial account. Any bank account or credit card information you provide is used solely for processing ACH transfers and credit card transactions in connection with funding your platform credit balance. Qixit does not store full credit card numbers beyond what is required to process a transaction. Financial information is subject to the security standards described in Section 12 and to our agreements with payment processors.
13A. Additional Data Processing for Redemption Program Participants
Users who enroll in the Qixit Redemption Program (the opt-in cash-conversion service described in the Redemption Program Terms) are subject to additional data collection and processing requirements. By enrolling in the Redemption Program, you consent to the following:
Tax Identification and W-9 Collection
Qixit is required by U.S. law to collect a completed IRS Form W-9 (or W-8BEN for non-U.S. persons, where applicable) from any Redemption Program participant before processing a cash disbursement. This requires collection of your full legal name, address, taxpayer identification number (SSN or EIN), and tax classification. This information is collected, stored, and processed solely for Qixit’s tax reporting obligations and will be shared with the IRS as required by law.
IRS 1099 Reporting
If your total cash disbursements in a calendar year equal or exceed the applicable IRS reporting threshold, Qixit will file an information return with the IRS and issue you a corresponding 1099 form by January 31 of the following year. The information included on the 1099 is shared with the IRS as a legal obligation.
Identity Verification and AML Compliance
The Redemption Program is subject to federal Bank Secrecy Act (BSA) and AML compliance obligations. Qixit may collect and verify government-issued photo identification, date of birth, residential address, and other identifying information required to satisfy Customer Identification Program (CIP) requirements. This information may be shared with Qixit’s compliance service providers and, where legally required, with FinCEN or other regulatory authorities.
Qixit may screen your identity information against the OFAC SDN list and other government watchlists at enrollment and periodically thereafter. If a match is identified, your enrollment may be suspended and the matter may be reported to relevant authorities as required by law.
Payment Processor Data Sharing
Cash disbursements are processed through third-party payment processors (including ACH networks, check issuance services, and gift card issuers). Your name, address, banking or mailing information, and disbursement amount will be shared with the applicable payment processor to the extent necessary to complete each disbursement. Each payment processor operates under its own privacy policy; Qixit requires all payment processors to maintain commercially reasonable security standards under data processing agreements.
Retention of Redemption Program Records
Records relating to Redemption Program disbursements — including W-9 forms, identity verification documents, disbursement records, and 1099 filings — are subject to mandatory retention periods under applicable tax and BSA/AML regulations. These records will be retained for a minimum of five (5) years from the date of the disbursement or as otherwise required by law, regardless of whether your Account or Redemption Program enrollment is terminated.
14. Additional Information
Any questions regarding this Policy should be directed through our Contact page.
This Policy is the sole authorized statement of Qixit’s practices with respect to the online collection of personally identifiable information and the usage of such information. This Policy should be read together with the Terms of Use, Service Agreement, Redemption Program Terms, Software License, and Earnings Disclaimer, all of which collectively govern your use of the Qix™ platform.
In the event of any sale or transfer of assets or our business to a third party, we reserve the right to transfer any and all information we collect to that third party, provided that the third party shall be bound by the same or stricter provisions as those in our agreements and this Privacy Policy.
